Under these Data Privacy Guidelines (hereinafter the “Guidelines”), GEMS MENASA Cayman Ltd. (hereinafter “Company”, “We” or “Us”) informs you on how We process your personal data. Your personal data means any information relating to you (hereinafter the “Personal Data”), including your name, contact details and information regarding your education and your past positions. 2.1. Categories of your Personal Data

These guidelines cover any personal information you submit our online job search tool as part of the job application or job search process that includes without limitation:

  • Name, address, telephone number, email address, other contact information;
  • Log-in and password;
  • CV, résumé, cover letter, previous work experience/history including salary and allowance, education, transcripts and other required attachments (passport copy, passport-size photograph, etc.)
  • Employment preferences, willingness to relocate, desired salary, marital status and family information;
  • Results of your assessments, if applicable
  • Information relating to references.

    If you intend to provide Us with details of a reference or any other third party as part of your CV/ résumé, it is your responsibility to obtain consent from that third party prior to passing their personal information to Us.

    You are responsible for the content of the information you provide to Us either directly or indirectly through an agent and you must ensure it is legal, honest, truthful, accurate and not misleading in any way. You must ensure that the information provided by you does not contain material that is obscene, blasphemous, defamatory, infringing on any rights of any third party, or otherwise legally actionable by such third party.

     

    2.2. Purpose of our Processing of your Personal Data

    We use your Personal Data for purposes related to your job application:

  • To assess your capabilities and qualifications for a job and potentially contact you about the position:
  • To conduct reference checks;
  • To develop questionnaires and interview scenarios;
  • To conduct background checks if you are offered a job;
  • To use as a reference data for future candidate if you are offered a job;
  • To create and submit reports as required by law or regulation
  • To contact you about career opportunities.

     

    The provision of certain of your Personal Data is a requirement necessary to assess your job application. This means that you have to provide these Personal Data to Us. The compulsory fields are marked with an asterisk. The consequence if you do not provide information to the compulsory fields is that We will not be able to assess your job application.

    If you become an employee, any personal information that you submit may become a part of your file and may be used for other employment/work-related purposes.

     

    3. Transfer of Personal Data to Third Parties

    We may provide your Personal Data to the Human Resources departments of the companies within the Company.

    We will not communicate your Personal Data to third parties, except to external providers involved in the recruitment process as well as third party services providers of the information system that require access to the data within the system to provide such services.

    The Job Applicants located in the European Union / European Economic Area (EU/EEA) are informed that some of recipients of Personal Data may be established in countries located outside the EU/EEA, where the regulation may not have the same level of data protection than in the EU/EEA. The Company has taken the appropriate steps to ensure an adequate level of protection of your Personal Data.

     

    4. Your Rights

    Under application data protection laws, you have rights:

  • Of access to, rectification of, and/or erasure of your Personal Data;
  • To restrict or object to its processing;
  • To tell Us that you do not wish to receive information;
  • In some circumstances, to require certain of your Personal Data to be transferred to you or a third party;
  • To withdraw your consent, without affecting the lawfulness of our processing based on your consent before its withdrawal.

To exercise your rights, you can contact Us as set out in Section 1 above. You can also lodge a complaint about our processing of your Personal Data with a data protection authority.

5. Law Applicable to Job Application

Our websites allows you to apply for jobs based in countries (or territories) other than the country where you are resident or from which you make your application. Job opportunities posted on our websites will be governed by the laws of the country where the job is located. By applying for a job through the Company or any of its subsidiaries or affiliates, you accept that (i) the laws of the country where the job is located will have exclusive jurisdiction over any disputes arising from your application; (ii) the laws of the country where the job is located shall apply to your application; and (iii) the Company, including the local entities in the country you submitted your application from, is not responsible or liable for the prerequisites or limitations your application is subject to under the laws of the country where the job is located.

These guidelines are not intended for distribution to, or use by, any person or entity in any jurisdiction or country where such distribution or use would be contrary to local law or regulation.

6. Changes to these Guidelines

We may change these Guidelines from time to time. All changes to these Guidelines are effective after they are initially posted on our website. If you do not agree to the changes, please contact Us to deactivate your account. You can always tell when We have last updated the Guidelines by checking in the “Last Updated” line at the beginning of these Guidelines.

 

7. Statement

I understand that any information provided to the Company, may be reviewed by the Company hiring representatives. I further understand and agree that these representatives may share this information with others on a need-to-know basis including, but not limited to, sharing it with hiring managers considering you for employment.

I understand that any falsification, misrepresentation, misleading statements, or omissions of fact on either my submitted material or during the pre-hire process will be sufficient reason for my not being offered employment. I also understand that the Company will also view discrepancies between my resume and the information provided on the application form as sufficient reason for my not being offered employment.

I understand that no time spent in obtaining a position with the Company, whether presently employed or in the process of becoming employed, is compensable.
